This Limited Warranty explains the coverage Foam N More provides for qualifying defects in materials and workmanship. It does not replace or expand Cancel, Refund, and Return Policy or Shipping and Fulfillment Policy. This Limited Warranty works together with Foam N More’s Website Terms and Conditions.
Foam N More warrants that the products it manufactures and sells will be free from defects in materials and workmanship under normal intended indoor residential or commercial use, as applicable to the product. This is a limited warranty and applies to the original purchaser unless otherwise required by applicable law.
Unless a different written warranty period is stated on the applicable product page, invoice, or other written product documentation, the limited warranty period is 1 year from the date of delivery. If a product category is assigned a different written warranty period, the product-specific written term controls.
This Limited Warranty covers manufacturing defects in materials and workmanship that cause the product to fail under normal intended use during the applicable warranty period. If Foam N More determines that a claim is covered, Foam N More may, at its option and subject to applicable law, repair the product, replace the defective product or component, or provide an appropriate refund or store credit if repair or replacement is not commercially reasonable.
Many Foam N More products are custom-cut, fabricated, sewn, or otherwise made to order. For those products, minor variations that do not materially affect function or conformity to the approved order specifications are not defects. This Limited Warranty covers defects in Foam N More’s materials and workmanship, but it does not guarantee that a customer-selected design, firmness, thickness, configuration, or custom specification will satisfy personal preference or a particular application unless Foam N More expressly agrees otherwise in writing.
To request warranty service, the purchaser must contact Foam N More within the applicable warranty period and within a reasonable time after discovering the alleged defect. The purchaser must provide:
Foam N More may require additional photos, measurements, or other documentation, and may require return of the product or component for inspection before approving a claim. Foam N More will provide instructions before any item is returned.
If Foam N More determines that a claim is covered under this Limited Warranty, Foam N More will decide, in its discretion and subject to applicable law, whether to repair, replace, or provide a refund or store credit for the defective item or component. Any replacement item may be the same item or a reasonably comparable substitute if the original is no longer available.
Unless prohibited by law or otherwise stated in writing, the customer is responsible for shipping or delivery costs associated with returning a product for warranty inspection when a return is required. If Foam N More confirms a covered defect, Foam N More may reimburse reasonable return shipping or provide replacement shipping at its discretion. If a replacement product is sent, it will ordinarily be shipped using the same shipping method as the original order unless Foam N More agrees otherwise in writing.
To the fullest extent permitted by applicable law, Foam N More’s obligations under this Limited Warranty are limited to the remedies described above. Foam N More is not liable for incidental, indirect, special, or consequential damages arising from the use of the product or from any claimed defect, except to the extent such limitation is prohibited by law.
Any implied warranties that cannot be disclaimed under applicable law are limited in duration to the duration of this Limited Warranty to the extent permitted by law.
Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply. This Limited Warranty gives specific legal rights, and other rights may vary by state.
